1. Agreement to Terms

By accessing or using MyTradingBuddy.ai ("the Service," "we," "us," or "our"), operated by Mango Villa LLC, a Wyoming Limited Liability Company, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, then you may not access the Service.

You must be at least 18 years old to use our Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this agreement.

2. Description of Service

MyTradingBuddy.ai is an AI-powered trading analysis and educational platform that provides:

  • AI-generated market analysis and insights
  • Trading pattern recognition and analysis
  • Educational content and trading strategies
  • Portfolio tracking and management tools
  • Technical analysis and charting tools
  • Market sentiment analysis

The Service is provided for informational and educational purposes only and does not constitute financial advice.

3. FINANCIAL DISCLAIMER AND RISK DISCLOSURE

THE INFORMATION PROVIDED BY MYTRADINGBUDDY.AI IS FOR EDUCATIONAL AND INFORMATIONAL PURPOSES ONLY AND DOES NOT CONSTITUTE FINANCIAL, INVESTMENT, TRADING, OR OTHER PROFESSIONAL ADVICE.

We are not a registered investment advisor, broker-dealer, or member of any financial regulatory body. The Service does not provide personalized financial advice or recommendations tailored to your specific financial situation, investment objectives, or risk tolerance.

AI LIMITATIONS AND RISKS

You acknowledge and understand that:

  • AI-generated analysis may contain errors, inaccuracies, or misleading information
  • AI cannot predict future market movements with certainty
  • AI analysis is based on historical data and patterns that may not repeat
  • Technical errors or malfunctions may occur in the AI system
  • The AI may not account for all market factors or unexpected events

TRADING RISKS

TRADING STOCKS, OPTIONS, FUTURES, FOREX, AND OTHER FINANCIAL INSTRUMENTS INVOLVES SUBSTANTIAL RISK OF LOSS AND IS NOT SUITABLE FOR ALL INVESTORS.

You may lose some or all of your invested capital. Only risk capital should be used for trading, and only those with sufficient risk capital should consider trading. Past performance is not indicative of future results.

4. User Accounts and Responsibilities

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for:

  • Maintaining the confidentiality of your account and password
  • Restricting access to your computer and account
  • Notifying us immediately of any unauthorized access or security breach
  • All activities that occur under your account

You may not use another person's account, and you may not allow another person to use your account.

5. Prohibited Uses

You agree not to use the Service:

  • For any unlawful purpose or to solicit others to perform unlawful acts
  • To violate any international, federal, provincial, or state regulations, rules, laws, or local ordinances
  • To infringe upon or violate our intellectual property rights or the intellectual property rights of others
  • To transmit any worms, viruses, or any code of a destructive nature
  • To attempt to gain unauthorized access to any portion of the Service
  • To scrape, harvest, or collect data from the Service without permission
  • To interfere with or circumvent the security features of the Service
  • To impersonate another person or entity
  • To sell, resell, or commercially exploit any portion of the Service

6. Subscription and Payment Terms

6.1 Fees, Billing Cycle, and Payment Processor

SUBSCRIPTION ACCESS IS A NEGATIVE-OPTION, AUTO-RENEWING PROGRAM. BY SUBMITTING PAYMENT, YOU AUTHORIZE US AND OUR PAYMENT PROCESSOR (STRIPE) TO CHARGE YOUR PAYMENT METHOD FOR THE TRIAL FEE AND ALL RECURRING RENEWAL CHARGES UNTIL YOU CANCEL.

Standard pricing (before any promotion code you enter at Stripe checkout) is: $14 USD for a 3-day trial, then $147 USD automatically every 28 days for continued access. The trial fee and each renewal are billed in advance for the applicable period. We may from time to time offer promotion codes; the only binding amounts, dates, and billing frequency are those shown on the Stripe checkout screen and on your Stripe receipt. If you do not agree to the exact figures Stripe displays, do not complete checkout.

All payment processing is handled by Stripe. You agree to Stripe's terms and privacy practices in addition to ours. We never receive or store your full payment card number on our servers.

6.2 NO REFUNDS POLICY

ALL SALES ARE FINAL. WE DO NOT OFFER REFUNDS FOR ANY SUBSCRIPTION FEES, TRIAL FEES, OR RENEWAL FEES PAID — PERIOD. THIS INCLUDES IF YOU CANCEL MID-CYCLE, IF YOU FAIL TO USE THE SERVICE, IF YOU ARE UNHAPPY WITH AI OUTPUT, OR IF WE TERMINATE YOUR ACCOUNT.

6.3 Auto-Renewal and Cancellation

Unless you cancel before the next billing date shown in your account / Stripe customer portal, your subscription will automatically renew and your payment method will be charged again. You may cancel through the same general account / self-service flow you used to subscribe (web account). Canceling stops future renewals only; it does not entitle you to any refund for the current or any prior billing period. See our Refund Policy.

6.4 Price Changes

WE RESERVE THE RIGHT TO CHANGE OUR SUBSCRIPTION PRICING AT ANY TIME, AT OUR SOLE DISCRETION, WITH OR WITHOUT NOTICE.

You acknowledge and agree that:

  • We may increase prices at any time for any reason
  • Price changes may be applied to your next billing cycle
  • If you do not accept the new pricing, your only recourse is to cancel your subscription
  • Continuing to use the Service after a price change constitutes acceptance of the new pricing
  • We may require you to pay the new price to continue using the Service

7. Intellectual Property Rights

The Service and its original content, features, and functionality are and will remain the exclusive property of Mango Villa LLC and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

8. DATA OWNERSHIP AND USER CONTENT

8.1 Complete Ownership of Your Data

ALL DATA, CONTENT, TRADING STRATEGIES, ANALYSIS, CHAT CONVERSATIONS, AND ANY OTHER INFORMATION YOU INPUT, UPLOAD, OR CREATE WITHIN MYTRADINGBUDDY.AI BECOMES THE SOLE AND EXCLUSIVE PROPERTY OF MYTRADINGBUDDY.AI.

By using our Service, you irrevocably transfer all rights, title, and interest in and to any data or content you provide to MyTradingBuddy.ai. We can do whatever we want with this data, including but not limited to:

  • Use it to improve our AI models and algorithms
  • Share it with third parties
  • Publish it publicly
  • Create derivative works
  • Commercialize it in any way we choose
  • Store it indefinitely
  • Analyze it for any purpose

8.2 No Privacy in Your Trading Data

You acknowledge that:

  • Your trading strategies and analysis are not confidential
  • We may use your successful strategies in our AI training
  • Your chat history and interactions belong to us
  • We have no obligation to delete your data, even if you request it

8.3 Perpetual License

You grant MyTradingBuddy.ai a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, transferable, sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display your content in any form, media, or technology.

9. Privacy Policy and Tracking

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy, which also governs the Site and informs users of our data collection practices.

BY USING OUR SERVICE, YOU EXPLICITLY CONSENT TO COMPREHENSIVE TRACKING INCLUDING:

  • Affiliate tracking cookies to attribute your subscription to marketing partners
  • Complete session recording and behavior analysis
  • Cross-device and cross-platform tracking
  • Sharing of your data with third-party analytics and marketing services
  • Retargeting across the internet
  • All forms of user activity monitoring

10. Disclaimers and Limitation of Liability

10.1 Service Disclaimer

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

10.2 Limitation of Liability

IN NO EVENT SHALL MYTRADINGBUDDY.AI, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY.

11. Indemnification

You agree to defend, indemnify, and hold harmless MyTradingBuddy.ai and its licensee and licensors, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees).

12. TERMINATION AND ACCOUNT SUSPENSION

12.1 Absolute Right to Terminate

MYTRADINGBUDDY.AI RESERVES THE ABSOLUTE AND UNCONDITIONAL RIGHT TO TERMINATE OR SUSPEND ANY USER ACCOUNT AT ANY TIME, FOR ANY REASON OR NO REASON AT ALL, AT OUR SOLE DISCRETION.

This includes but is not limited to:

  • Any reason MyTradingBuddy.ai deems suitable for our interests
  • Suspected abuse of the system
  • Violation of these Terms (as determined solely by us)
  • Behavior we consider inappropriate
  • Business or strategic decisions
  • No reason whatsoever

12.2 No Refunds Upon Termination

IF YOUR ACCOUNT IS TERMINATED FOR ANY REASON, YOU WILL NOT RECEIVE ANY REFUND OF SUBSCRIPTION FEES, REGARDLESS OF HOW MUCH TIME REMAINS IN YOUR BILLING PERIOD.

This applies even if:

  • You have just paid for a new subscription period
  • You have not violated any terms
  • The termination is for our convenience
  • You have an annual subscription with months remaining

12.3 Effect of Termination

Upon termination:

  • Your access to the Service will be immediately revoked
  • You will lose access to all your data, analysis, and content
  • You may be permanently banned from creating new accounts
  • No refunds will be provided under any circumstances

If you wish to terminate your account voluntarily, you may cancel your subscription, but no refunds will be provided for any remaining time.

13. Governing Law and Disputes

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Any disputes arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
